Terms of service

These terms apply to the hosted Masthead service at masthead.site, including the dashboard, the marketplace and the sites it hosts. By creating an account you agree to them. How we handle personal data is described in the privacy policy.

1. Who provides Masthead

Masthead is provided by Dijkstra Software, a sole proprietorship registered in the Netherlands with the Chamber of Commerce (KvK) under number 97259993. Contact: hello@masthead.site.

The Masthead software is open source under the MIT license. These terms cover the service we run, not your use of the source code, which the MIT license governs.

2. Your account

• You must be at least 16 years old to create an account.
• Give a working email address and confirm it. Accounts that aren't confirmed within 30 days are suspended until they are.
• Keep your password and sign-in methods secure. You are responsible for what happens under your account, including what collaborators you invite do on your sites.

3. Free sites and site licenses

• Every site starts on the free plan, which has no time limit.
• A site license is per site and adds paid features such as a custom domain, collaborators and visitor statistics. Current prices are on the pricing page.
• Licenses are billed in advance, monthly or yearly, through Stripe, and renew automatically until you cancel.
• You can cancel at any time. The site stays licensed until the end of the period you paid for and then returns to the free plan; your content is not affected.
• Payments are not refunded, also not for a partly used period. This doesn't limit any rights you have by law as a consumer.
• We announce price changes at least 30 days before they apply to your next billing period.

4. Your content

You keep all rights to the content, uploads and themes you put on Masthead. You give us permission to store, process and publish them only as far as needed to run your sites and the service. You confirm that you have the rights to everything you upload.

You are responsible for your sites, including complying with the law that applies to them, such as privacy rules for any personal data you publish or collect on them.

5. What isn't allowed

Don't use Masthead to publish, host or send:

• anything illegal, including content that infringes someone else's rights;
• malware, phishing, or sites that impersonate others;
• spam or unsolicited bulk messages;
• content that sexually exploits minors, or that threatens or harasses people;
• attempts to break, overload or get around the security of the service or the sandbox that themes run in.

To report content on a Masthead site that you believe is illegal, email hello@masthead.site with the address of the page and why. We review every report and tell you what we decided.

If a site or account breaks these terms, we may take the content offline, suspend the site or close the account. Where we can, we warn you first and explain why.

6. Themes and the marketplace

• Only upload themes you have the right to distribute.
• By publishing a theme to the marketplace, you allow every Masthead user to install and use it on their Masthead sites.
• We may remove a theme from the marketplace if it breaks these terms or doesn't work.

7. Custom domains

You may only connect domains you control. You remain responsible for the domain's registration and DNS; we provision the TLS certificate once ownership is verified.

8. Availability and changes

We work to keep Masthead available and your data safe, but the service is provided as is, without a guaranteed uptime. Keep your own copies of content you can't afford to lose. We may change or remove features; if a change takes away something you pay for, we tell you in advance.

9. Liability

Our total liability to you is limited to the amount you paid us in the 12 months before the event that caused the damage. We are not liable for indirect damage such as lost profit or lost data. These limits don't apply to damage caused by our intent or gross negligence, or where the law doesn't allow them.

10. Ending your account

You can stop using Masthead at any time. To have your account and sites deleted, email hello@masthead.site from the account's address. Cancel any site licenses first; we don't refund the remaining period.

11. Changes to these terms

We may update these terms. For significant changes, we email account holders at least 30 days before they take effect. If you don't agree, you can close your account before then.

12. Law and disputes

Dutch law applies to these terms. Disputes go to the competent court in the Netherlands. If you are a consumer living elsewhere in the EU, you keep the protection of the mandatory rules of your country and can also bring a claim there.
